OUR 3 STEP CHINA IP REGISTRATION PROCESS

Applying for a trademark is a straight forward.

Step 1: We first need to check whether it is still possible to register, and if there are any similar or “like” competing marks. This is delivered in a report allow 2 working days.

Step 2: Once clear we then need to receive your official KYC documentation the legal team will take care of all official registration procedures on your behalf. This may take 4-8 weeks before initial confirmation of application is received. Companies and brands can then show proof of application and begin to sell inside China.

Step 3: Final confirmation is after 9-12 months. Your trademark is counted and registered from the original date of application.

How much does it cost to secure my China Trademark?

China IP Legal Check and Report: costs USD $150 and takes 2 working days. Checks if the brand has been copied or squatted (or not)! We then can give you the good news to proceed.

IP Registration Costs average* CNY 6000-8000 per-mark depending on sector and any supplementary paperwork that may be required and excluding local China taxes.

Note: a BRAND LOGO + BRAND NAME are 2 separate-marks.

Most brands will choose to register both their name and their logo. We often advise to also register a Chinese version of your brand name for security and potential later use.

Why is my China trademark IP important?

Many companies get caught out thinking that they already have a “global trademark IP rights “ without realising that brand trademarks must be registered in China for them to be recognised by local Chinese law.

Without securing your trademark in China, even beginning to promote your brand and IP is a risk. This includes attending trade fairs, or online marketing from your local area.

Can a foreign business (or person )register and own local China IP and trademarks?

Yes. You do not need to be a registered Chinese business nor need to hold a Chinese passport to own your Trademark and IP inside China. A passport and other supporting KYC documentation is all that is required.

(E.g. For people manufacturing and exporting from China registering the trademark/s helps prevent suppliers from being tempted to selling branded goods inside China).

What is China Trademark Squatting?

China IP is a “first to apply” registration process.

Chinese IP laws do-not recognise having prior use of the trademark outside of China. Nor is a local applicant verified if they have had any connection to the original foreign brand and/or company. It has unfortunately resulted in “trademark squatting” whereby anyone in China can register any trademark or brand and claim it as their own and then offer it for sale to buyers.

Trademark squatting can be a lucrative business. This happens all-too often and even large firms get caught out. For example: Apple famously had to pay over USD $50 million to recover their “IPad” brand name from a squatter!

How is a Trademark Registered in China?

There are only two ways to register a trademark in China; via the national China registration via a China trademark agent (our legal partners are an appointed agent with government license) or, via an international registration via WIPO.

National China registration: is highly recommended as it is faster (9-12 months vs 12-24 months) and clients obtain an official trademark certificate which is requested by many sales and distribution channel partners, outlets, business partners and others.

The WIPO international system classes and China classes vary, which often leads to application not being awarded due to lack of corresponding subclasses (lost in translation).

Once registered any potential upcoming appeal must be filed locally by an agent in China. Finally, using a local (China) firm is also faster and generally cheaper than using an international firm to do the same local filing.

How fast can I start selling online to China?

Generally 4-5 weeks if your current China pages and website are “ready to go” and/ or your product has already been shipped and ready for distribution in China. With new websites we still need 2-4 weeks to complete all China platforms and paperwork and accounts processes. Once approved you can begin marketing and selling online and offline with our live China customer service and point of return support, and begin online digital marketing campaigns.

I want to start to sell online to China, must I have a China company?

to answer this Q we always must 1st ask A) what are you are selling and B) where is the stock located before it is shipped?

If your stock is already inside China, and you are selling inside China, then yes, you do need a China company or a local China partner (and we provide this service as part of our company and when required, official levels of partnership with clients).

However: If your stock is not-inside mainland China (e.g. stock or service is from H.K. or E.U., Aus/NZ or USA) and you are selling into China, then there is no-need for China company.

Once I start selling, then will I need a registered company, or a joint-venture in China?

99% of the time the answer is “no.” As long as your stock/product/goods or service is not located inside mainland China at POS. However, you still must-have a "China point of return" or "point of business contact" for both customer service and the majority of 3rd party platforms also make it a requirement. Not to worry as China Sales Co. provides all these "essential for China e-commerce business" services. Meanwhile your product and service/s can still be sold from directly "your-home-brand.com" website and you get paid via real-time cross border currency settlements directly into your business bank account.

Can you do China IP protection?

Yes, this is handled via our China legal partners. If you are running a successful business, and have exported to China in the past then unfortunately you might find your brand has already been registered inside China. It is essential to get IP protection done before launching into China. The cost to register trademark and domains is tiny compared the loss and costs of getting your brand back from pirates. As well as trademarks we assist "cyber squat" clients online identitiesin Social Media platforms and domains to ensure our client's brand name is secure well before launch into the market..

Do I need a "MY-STORE.CN" website or a Chinese domain name?

For the few businesses that do require a .cn URL we offer ICP and hosting services from our Shanghai offices terms and conditions apply.

The majority of international businesses do-not need a Chinese domain (your-brand.cn) URL to start selling online to China. Rarely will we advise that is is "essential" unless you are in a particular sector or campaign.

Proof of business and IP ownership, supply of registered business documents and account paperwork supplied by China Sales Co. is all that is required for initially setting up China Search and Advertising accounts.

How do I get an Alipay account and how much does it cost?

Easy, just "click here"> and fill in application form with as much detail as possible. (We do need at minimum an official company contact, email and official address to submit paperwork for review / application).

Since June 2014 China Sales Co. has been a licensed global Alipay partner. China Sales Co. is a global licensed Alipay account provider and System Integrator and tester.

Once forms are submitted it then takes 3-4 weeks for approval and installation and testing.

Alipay accounts are free for merchants. China Sales Co. may charge a one time fee for for installation and testing based on the technical requirements (requirement depending).

Can you provide after hours sales support?

Yes we can offer 24/7 China sales support for e-commerce clients however no client has this need currently. Apart from the crazy e-sales days we find there needs to be flexibility built into CRM scheduling with little or no CRM activity required after 10PM.

How many Chinese web pages will I need?

We advise starting with at-least 15-20 quality translated web pages of content to begin with.

How much does a starting a Tmall or Tmall Global store cost?

Set up costs and annual running costs are cheaper than a bricks and mortar store, and you will reach millions of online buyers keen for your qualified product and service.

Once running, annual store lease and store operations can be as little as $950 per month (excluding commissions and advertising).

All figures below are in $USD.

  1. Tmall application forms: free from China Sales Co.
  2. Tmall 12 month store lease: $5,000 or $10,000 depending on commodity and sector.
  3. Alipay application and installation and testing: $2,000-$10,000+ depending on web store and requirements. Alipay offshore payment system is a requirement for merchants selling on Tmall.*
  4. Tmall store design: $5,000-$25,000+ depending on number of SKUs
  5. Tmall store Operation: $12,000-$50,000+ per year plus variable commission on units sold (for annual service only ask for terms and conditions).
  6. China Point of Return and quality control: included with China Sales Co. store operations. *
  7. Tmall surety fee: 1 x $25,000 surety fee (deposit) Held by Alibaba in case of dispute and refunded on store closure.

note*Alipay and "China Point of Return" can be ordered separately without requiring a Tmall store.

Must you be our agent or can we order your services separately?

Of course. You can order just what you need. Clients often need just assistance with paperwork, logistics, quality control or inspections, China web design, Social Media Accounts and we are happy to provide by requirement.

For example we provide Alipay account and installation and testing, China e-commerce consulting and research, web design, translations and application development services.

For ongoing e-commerce support our live in-market live sales support and customer relationship support services these must be ordered as part of partner packages and these do-have minimum terms and conditions that apply see your service contract for details.

How long is the minimum Live Sales Support period?

For live sales support generally our contracted agent service term is 12 months (1 year) however we can also support shorter terms for 90 day or 180 day marketing campaigns. See our service supply contract for full details terms and conditions that apply.

How can I speak to China Sales Co. and learn how my sales are going?

Your account team will be live on Skype or other channel or to ensure we can be reached at all times during Chinese business hours. For those on 24/7 sales support services your account team are contactable at any time.

What pricing do I need to consider for shipping?

There are literally hundreds of options, so we always advise to "shop around your local logistics providers and get a bargain." Depending on your product and pricing there may also need to be import duties paid (generally by the shipping agent) or, we can "meet and greet the container" when it arrives and handle it from there. Please do-not contact us and ask for quotes for shipping product "from your home town to our port" as you will find your local agent will always beat any international quotes. We are happy to work with them and to then quote paperwork and storage/warehousing and logistics for once the goods arrive in China/ or in a China FTZ zone.

Can you handle imports and exports?

Current minimum SEM Credit value is USD $5,000. This is deposit for your advertising credit and it is valid for use for 12 months.

China Sales Co. provides expert Baidu SEM advertising, including PPC Key Word Analysis, banner and ad designs, Baidu Brand Zone and Baidu network content distribution.

Our SEM services are for 3 campaign- months or 90 days of advertising (within a six month period). We provide KPI and campaign management and reporting services. China Sales Co. is a licensed Baidu partner ask us for your application today.

Expert China SEO "takes time" and ranges from as little as $1,500 per month minimum 6 months (1 core key word/key phrase only) and up to $5,000 per month for multiple core key words and phrases.
